Family Law

Family Law and De facto Agreements on commencement or termination of a relationship.

If you are unable to settle a property distribution between you on the breakup of your marriage or de-facto relationship, I can assist by advising you of your legal rights. Both same-sex and opposite-sex relationships are governed by the Property (Relationships) Act. This enables you to apply to the court to make the determination for you. Under the Act this must be within at least two years of your breakup.

I will need to discuss with you the background and financial contributions of your ex-partner as well as yourself so that I can advise you effectively of your rights.

There is usually no fee for the first conference should you not wish me to act for you.

Tip Always discuss with your partner to ensure that it is clearly understood how the financial aspects of your relationship will work. If for example one partner pays the rent or mortgage and the other the food and other outgoings, ensure this is clearly understood. Keep records such as receipts, bank statements, etc so that if need be you can prove what you paid.
