Buying, selling and re-financing of property, including houses, home units, businesses, franchises, etc.

The title to most properties is now governed by the Real Property Act. For these I charge a basic fee which is the same for sales and purchases. This fee covers the sale or purchase of a property together with the discharge of a mortgage on sale, and on a purchase, a new mortgage on the purchase. If more than one mortgage is involved there will be a further small additional fee of between $50 and $100, depending on the circumstances.

There are still some properties the titles to which have not yet been registered, called “Old System” or “Common Law” title. There are also some home units where the title is not registered and involves the purchase of shares in a company which manages the block of units. This is called “Company Title”. I will need to give you a specific quote in respect of either of these matters.

If you are buying a property at auction, it makes sense to let me look at the contract as soon as possible before the auction date. I can then request amendments if required. If you are unsuccessful there is no charge for this service. If you are successful, there will be a further charge of between $50 and $100 depending on how much negotiation and work was required.

Tip

When inspecting a property, don’t be shy. The seller or vendor is not usually there, so take the opportunity to be as nosey as you can. Turn the lights on and check the security and air-conditioning if available. Go to the bathroom and flush the loo even if you haven’t used it.

Keep your eyes open and look for anything that would suggest recent structural alterations or additions. Often a vendor may not have obtained the appropriate permissions for their new carport, garage or rear extension.
